Scarborough, Woody Point and Clontarf have a much older median age than Moreton Bay as a whole. Most estates we act in here involve a long-held waterfront or post-war home, modest shares and superannuation — and a will signed decades ago.
Units and body corporate records slow estates down
A great deal of Scarborough housing is unit and townhouse stock. Transmitting or selling a unit in an estate means the body corporate records, levies and any outstanding building work have to be in order before settlement, and that is usually the step that stalls.
How the title is held decides whether probate is needed
Joint tenants pass to the survivor by survivorship, so a grant is often unnecessary. Sole ownership or tenants in common does not, and a grant of probate is generally required before the property can be transmitted and sold.
Superannuation is not covered by the will
Super is paid under the fund's rules and any binding death benefit nomination, not automatically under the will. For couples with a self-managed fund or an out-of-date nomination, that is the most common gap we find.
Retirement villages and aged care on the peninsula
