Serving Maroochydore
Maroochydore conveyancing and property lawyers
Maroochydore is the Sunshine Coast's commercial centre and its biggest off-the-plan market. Those two things drive most of the contract risk here.
We act for Maroochydore buyers, sellers, investors and business owners on fixed fees. Every file is run by a solicitor, and settlement is electronic through PEXA, so you deal with the same person from contract review to the confirmation that settlement has occurred.
The Maroochydore city centre precinct has produced a steady stream of off-the-plan apartment contracts. These are not standard contracts. The sunset date, the developer's rights to vary the plan, the finish schedule, the disclosure regime under the Body Corporate and Community Management Act and your ability to terminate if the scheme changes materially all need to be assessed before you sign — a valuation shortfall at completion is the single most common problem we are asked to fix, and by then the options are limited.
For established stock, the usual body corporate work applies: sinking fund adequacy, defect history, insurance, special levies and by-laws. For houses in the surrounding pockets, flood and overland flow mapping matters — parts of Maroochydore sit low against the river and the Cornmeal Creek system.
On the commercial side we act on retail and office leases, assignments of lease including Form 12 legal advice reports, and business sales in the precinct. Being a law firm rather than a conveyancing service means a property purchase that turns into a leasing or business question does not have to be sent elsewhere.
What we watch for in Maroochydore
Off-the-plan apartment contracts
Sunset dates, variation rights, disclosure updates and your termination rights. We explain what you are committing to years before completion, and what happens if the valuation lands short.
Flood and overland flow
The river and Cornmeal Creek catchments affect insurance and future building work. We read the flood search rather than the agent's summary.
Body corporate due diligence
Levies, sinking fund forecast, defect and remediation history, insurance valuation and by-laws on letting and parking.
Commercial leases and business sales
Retail Shop Leases Act disclosure, assignment consents and Form 12 legal advice reports for assignees — handled in-house on fixed fees.

Local questions
Should a lawyer review an off-the-plan contract before I sign?
Yes, and it is the cheapest legal work you will ever buy. Off-the-plan contracts are drafted for the developer: they set a sunset date, reserve rights to vary the plan and finishes, and bind you for years. We review the contract and disclosure statement before you sign and set out your termination rights in writing. There is no charge for the review.
What happens if the valuation comes in below my off-the-plan price?
You are still contractually bound to complete. The lender lends against the valuation, so you must cover the shortfall from your own funds. That risk is best assessed before signing — we flag it, along with the settlement funding requirements, at the review stage.
Do you act on commercial property in Maroochydore?
Yes. Commercial purchases and sales, retail and office leases, assignments, and Form 12 legal advice reports for lease assignees. We also act on business sales including the plant, stock and restraint provisions.
