The physical land is the first issue. Buderim's slope brings retaining walls, batter and stability questions, overland flow and stormwater paths, and vegetation and bushfire overlays. Retaining structures built across boundaries, or without approval, are common and become the buyer's liability after settlement. Where a property has a granny flat, studio or second dwelling, we check whether it is approved and whether it can lawfully be let.
The second issue is that a large number of Buderim transactions are life-stage transactions: downsizing from the family home, moving into a retirement village or over-50s community, or a family selling after a parent has died or moved into aged care. Each of those raises questions a conveyancing-only business is not able to answer — Centrelink and pension consequences, whether an enduring power of attorney permits the sale, capacity, and whether the will still reflects what is being done.
We prepare wills, testamentary trust wills, enduring powers of attorney and advance health directives, and act for executors on probate and estate administration, including transmission of the family home to beneficiaries. When a Buderim sale is really part of an estate or an aged care move, that is all handled by the same firm.
What we watch for in Buderim
Slope, retaining walls and stability
Who owns and maintains the retaining structure, whether it was approved, and what the geotechnical and overland flow records show. Very often unresolved in the contract.
Secondary dwellings and granny flats
Approval status and whether the dwelling can lawfully be let separately. An unapproved second dwelling affects value, finance and insurance.
Downsizing and retirement villages
Village contracts are a right to reside, not freehold. We explain the exit fee, refurbishment obligation and buy-back timing before you or your parent commits.
Selling under a power of attorney
An attorney selling the principal's home must comply with strict duties and conflict rules. We confirm the authority is valid and the sale is properly documented.

Can my attorney sell my house under an enduring power of attorney?
Only if the enduring power of attorney is validly made, the financial power has commenced, and the attorney complies with the duties in the Powers of Attorney Act — including the conflict transaction rules, which restrict selling to themselves or a related party without authorisation. We check the document and the circumstances before the property is listed, because a defective authority can unwind the sale.
We are selling Mum's Buderim house after she died. What do we need?
Usually a grant of probate (or letters of administration if there is no will) before the title can be dealt with, though a contract can often be signed earlier with the right conditions. We handle the grant, the transmission application and the sale together so the timing works.
Do you review retirement village contracts?
Yes. We go through the deferred management fee, refurbishment and reinstatement obligations, the buy-back or resale timeline, ongoing service charges, and confirm the disclosure documents required under the Retirement Villages Act were given before signing.
