My mother is starting to lose capacity — is it too late for a will?
It depends on the level of capacity at the moment of signing, and that is a legal test rather than a medical label. We assess it, document it and sometimes obtain a specialist opinion. If capacity has gone, the alternatives are a QCAT-appointed administrator or, in limited cases, a statutory will application.
How much does a will cost in Currimundi?
A simple will is a fixed $495 including GST, an enduring power of attorney is $330, the will and enduring power of attorney pack is $825, and a couples pack is $1,499. Wills involving blended families, companies, trusts or a self-managed super fund are quoted separately in writing before we start.
Do I need an enduring power of attorney as well as a will?
They do different jobs. A will operates after death; an enduring power of attorney lets someone deal with your finances and, if you choose, your personal and health matters while you are alive but unable to decide for yourself. Without one, your family has to apply to QCAT, which takes months and costs far more than the document would have.
Can you come to me in Currimundi?

Where is the original will kept?
We hold originals in safe custody free of charge and give you a copy for your records. That matters more than people expect — an original that cannot be found, or one that has been stapled, pinned or torn, creates an affidavit problem for your executor at exactly the wrong moment.
Can my will be challenged?
In Queensland an eligible person — a spouse, child or dependant — can bring a family provision application within nine months of death. A will cannot make that impossible, but the way it is drafted, and the file note that sits behind it, makes a claim much harder to run. We ask the awkward questions at the time we take instructions.
