Aura is Australia's largest master-planned community, and conveyancing here is a different exercise from buying an established home. Nearly every file is a developer contract, a house and land package, an off-the-plan lot in a new release, or a first resale of a home only a few years old. The risk sits in the paperwork rather than the bricks.

House and land buyers sign two contracts. The land contract settles on plan registration, the building contract runs for a year or more afterwards, and finance has to cover both. We read the land contract, check the sunset date and the developer's right to vary the plan or the lot dimensions, and diarise every notification period so you are not caught by a deadline you never saw.

The Aura covenant is the part buyers most often skip. It sets build commencement and completion timeframes, approved external materials and colours, driveway, fencing and landscaping standards, and restrictions on parking and storage. It binds you after settlement and it is enforceable, so we tell you in plain terms what it will require before you sign.

On house and land, we make sure the land contract and the building contract line up with your finance approval.

Buying a first resale in Baringa, Nirimba or Banya

Homes only a few years old still carry the covenant, and the builder's warranty position, incomplete landscaping and defect rectification are all worth dealing with in the contract rather than after settlement. Where the lot sits in a community title scheme we read the levies, sinking fund and by-laws as well.

Selling in Aura — the Form 2 seller disclosure

Since 1 August 2025 a Queensland seller must give a completed Form 2 disclosure statement, with the prescribed certificates attached, before the contract is signed. We prepare it as part of the $990 inclusive of GST sale fee so a paperwork defect does not hand your buyer a termination right on the eve of settlement.

Aura conveyancing questions

What is a sunset date in an Aura off-the-plan contract?

It is the long-stop date by which the plan must register and the contract must settle. If registration has not happened by then, one or both parties can usually terminate. Developers frequently reserve rights to extend it, so we check who can terminate, on what notice, and what happens to your deposit.

Do you review the building contract as well as the land contract?

The land and the build are separate contracts with separate risks and finance usually has to cover both. The land contract is reviewed as part of the fixed fee, and we flag the building contract terms that cause the most trouble — progress payments, variations, prime cost and provisional sums, and completion dates.

When do I pay transfer duty on an off-the-plan lot in Aura?

Duty is generally assessed on the contract and payable within 30 days of the contract becoming unconditional or of settlement, depending on how the contract is structured. On an unregistered lot that can be well before you get the keys, so we set out the timing and any home or first home concession that applies before you commit.

Solicitor or conveyancer — does it matter in Queensland?

Queensland does not licence non-lawyer conveyancers the way New South Wales and Victoria do; a property transfer here is legal work done by a law practice. The difference shows up when a file turns awkward — a caveat, a deceased estate on the title, a family transfer with a duty question, a contract that needs terminating. We deal with all of it in-house rather than referring you on.

What about the seller disclosure statement?

Since 1 August 2025 a seller must give the buyer a completed Form 2 seller disclosure statement, with the prescribed certificates attached, before the contract is signed. Get it wrong and the buyer may be able to terminate right up to settlement. We prepare the Form 2 for sellers and check it carefully for buyers.

Do I have to come into an office?

No. Queensland residential settlements run electronically through PEXA, so there is no cheque handover. You complete a verification of identity and sign a client authorisation, and the file runs from there.
