Sunshine Coast hinterland conveyancing questions

Can I subdivide an acreage property after buying?

Do not assume so. Zoning, local controls, access, services and overlays can all matter. Obtain appropriate planning advice before committing if subdivision is essential to your purchase, and discuss suitable contract protection with us.

Does the residential fee cover a farm or business purchase?

Not automatically. Send the contract and intended use so we can identify the work and quote it. Business assets, commercial operations and specialised due diligence are separately scoped.

More about conveyancing in Sunshine Coast hinterland

By Michael Klein · Coastside Law

Coastside Law is a Queensland law practice doing conveyancing in Sunshine Coast hinterland. Conveyancing Sunshine Coast hinterland and Sunshine Coast hinterland conveyancing are handled by an admitted solicitor — not a processing centre — on a fixed fee of $990 inclusive of GST for a residential sale and $1,499 inclusive of GST for a purchase, plus searches and government charges at cost. Contract review before you sign is free, settlement runs electronically through PEXA, and you can reach us on 0488 340 853.

A solicitor, not a processing centre

Your file is run by an admitted Queensland solicitor who can give you legal advice on the contract, not a paralegal in a call centre who can only move paperwork.

Local, not national

We work from the peninsula and the Sunshine Coast. We know the councils, the overlays, the body corporates and the local agents — because we deal with them every week.

Fixed fees, quoted in writing

No 'from' pricing that grows at settlement. You get the professional fee in writing before we start, with searches and government fees itemised.

Free contract review before you sign

Send the contract through and we will read it and tell you what needs changing — at no cost and with no obligation to instruct us.

Buying in Maleny, Montville or the surrounding hinterland can mean a village home, a larger rural-residential block or a property with a very particular access and services arrangement. Start with the land you are buying and the use you have in mind. A bigger block is not automatically a block you can divide or build a second home on.

Access deserves a proper look. Does the property reach a public road, or does it depend on an easement over someone else’s land? What do the title documents say about using and maintaining that access? A track you can drive along at the inspection is not, by itself, proof of the legal rights you will acquire.

Tell us whether the property uses tanks, a bore or on-site wastewater treatment, and whether sheds or other buildings will be part of your plans. Approvals and service arrangements need checking as relevant, while condition, capacity and suitability require the right inspector or specialist. Legal searches do not certify a wastewater system or a water supply.

Maleny and Montville have local planning controls, and applicable overlays vary by lot. Bushfire, vegetation, waterways and other planning information may affect a proposed use or building project; a mapping layer alone is not a conclusion about the property. We act from Golden Beach. Commercial farming, a business sale or other non-standard work needs its own scope and quote rather than an assumed residential fee.

Contract review before you sign

We read the contract, the disclosure statement and any special conditions before you commit. Once signed, your options narrow to the cooling-off period and whatever conditions are already in the document.

Critical dates managed

Cooling-off, building and pest, finance and settlement dates are diarised and chased. Most disputes we are asked to fix started as a missed or badly worded extension.

Settlement through PEXA

Electronic settlement with funds and title transferring online, adjustments for rates, water and body corporate levies calculated and checked.

Council information for your property

Solicitor or conveyancer — does it matter in Queensland?

Queensland does not licence non-lawyer conveyancers the way New South Wales and Victoria do; a property transfer here is legal work done by a law practice. The difference shows up when a file turns awkward — a caveat, a deceased estate on the title, a family transfer with a duty question, a contract that needs terminating. We deal with all of it in-house rather than referring you on.

What about the seller disclosure statement?

Since 1 August 2025 a seller must give the buyer a completed Form 2 seller disclosure statement, with the prescribed certificates attached, before the contract is signed. Get it wrong and the buyer may be able to terminate right up to settlement. We prepare the Form 2 for sellers and check it carefully for buyers.

Do I have to come into an office?

No. Queensland residential settlements run electronically through PEXA, so there is no cheque handover. You complete a verification of identity and sign a client authorisation, and the file runs from there. Our peninsula office at 15 Fortune Street, Scarborough QLD 4020 is available by appointment if you would rather meet in person.

We act on property across Sunshine Coast hinterland and Maleny, Montville, Mapleton, Flaxton, Palmwoods, Woombye from 40 Theresa Street, Golden Beach QLD 4551. Erin Wilkinson will usually run your file.
